Philips Moves Delhi High Court, Seeks Ban On Xiaomi Phone Sale In India

Philips has moved the Delhi High Court to prohibit Xiaomi from selling its phones that infringe its patents.

Filing a case against Xiaomi India, the company has asked the Delhi High Court to ban sales of Xiaomi mobile phones that violate the company’s patents.

In its plea, the tech giant has sought restraint against manufacturing or assembling, importing, selling, offering for sale, and advertising, including through its and third-party websites, certain smartphones.

The call for the ban is for certain phones from Xiaomi that use Philips’ patented Universal Mobile Telecommunications Service (UMTS) enhancement technology such as High-Speed Packet Access (HSPA), HSPA+, and LTE. So, it sought royalty for the use of its technology, but Xiaomi has been nonresponsive.

Philips also sought an ad-interim order of injunction directing the Central Board of Excise and Customs to issue necessary instructions to custom authorities at every Indian port, including airports, to restrict import of Xiaomi handsets, including the models specified in its application.

After hearing the appeal from Philips, the court on November 27 passed an order passed on order directing Xiaomi’s Indian subsidiary to maintain Rs 1,000 crores in their bank accounts in India on or before December 2.

The court order reads, “…the defendants shall maintain in their bank accounts operated in India an amount of Rs. 1,000 crores. The said statement is taken on record. It is made clear that the defendants are bound by the statement given by their counsel. The defendants shall file the details of the bank accounts operated in India where the amount of Rs. 1,000 crores is being maintained, on or before December 2, 2020.”

The court order also directed that the reply should be filed within four weeks. The next hearing is on January 18, 2021.
